Mr. Scaletta has been representing Personal Representatives and Trustees in the administration of decedent’s trusts and estates for over twenty years. The Florida statutes and the governing documents impose certain duties on fiduciaries to ensure that a decedent’s wishes are properly carried out. Fiduciaries are responsible for collecting the decedent’s assets, notifying potential creditors, informing and accounting to the probate court or the beneficiaries, resolving the claims of creditors, resolving and satisfying tax obligations, and properly distributing the assets to the beneficiaries.
These duties are highly regulated by the Florida statutes, the Internal Revenue Code, and the governing documents, and must be carried out properly and according to law.
